David de Knijff

David de Knijff is a partner at Ekelmans & Meijer, where he specialises in Supreme Court litigation cases. He has a great deal of experience with litigation regarding numerous property law topics in the fields of contract law, liability law and insurance law, experience that he initially acquired in district courts and appeal courts and later in the Supreme Court.
David de Knijff gives advice and conducts legal proceedings, mainly in Supreme Court cases. That means that he first assesses what the chances are that a decision taken by the court of appeal might be overturned by the Supreme Court. That assessment requires precise analysis of the proceedings up to that point, both in the district court and the court of appeal, and thorough knowledge of the law, case law and doctrine. If enough pointers for arguing the case in the Supreme Court can be found, David brings an appeal to the Supreme Court and conducts the legal proceedings in that court. He also puts forward the defence in the Supreme Court if a ruling in favour of the client is challenged by the opposing party and needs to be defended in that court. He is often approached for advice by other lawyers when they are dealing with complex cases because of his specialist know-how and because he knows how district courts and courts of appeal work in judging civil-law cases. Furthermore, David provides assistance in professional liability cases.

David has been a member of the Supervisory Council for the Dutch Bar Association at the Supreme Court of the Netherlands (with the portfolio of Supreme Court appeals, civil law and civil procedural law) since 2010. David became a Dean in the district of The Hague in November 2015.

Education
David studied Dutch and international law at Utrecht University. He obtained a Master’s in European and comparative law at the European University Institute in Florence. He works for the Tijdschrift voor Civiele Rechtpleging.

Work Experience
David started his career at Trenité van Doorne in Amsterdam in 1990. In 1998 he moved to that firm’s office in The Hague, where he progressed from the general litigation practice to the Supreme Court litigation practice. He joined the Ekelmans & Meijer Advocaten partnership on 1 January 2001.

He has a great deal of expertise and experience with litigation regarding numerous property law topics, ranging from contract law and liability law to insurance law and insolvency law. He has given – and still regularly gives – talks and courses on procedural law, contract law and current developments in the case law of the Supreme Court that are relevant for practising lawyers.
